Firearms in the Courthouse Prohibition

RESOLUTION NO. 91-152

 

WHEREAS, the county courthouse is a building wherein numerous persons enter, transact business, participate in and observe judicial and other governmental proceedings; and,

 

WHEREAS, the control of firearms in the county courthouse building is in the interest of the public health, safety and welfare of the citizens of Shawnee County.

 

NOW THEREFORE, the Board of County Commissioners of the County of Shawnee, Kansas, meeting in the regular session on this 1st day of October, 1991, does hereby resolve as follows:

 

  1. Possession of a firearm within the county courthouse building is possession of a firearm by a person who brings a firearm into, or possesses a firearm within the county courthouse building.
  2. Possession of a firearm within the county courthouse building is prohibited.
  3. This resolution shall not apply to or affect any of the following:
  4. Law enforcement officers, or any person summoned by any such officers to assist in making arrests or preserving the peace while actually engaged in assisting such officer;
  5. Wardens, superintendents, directors, security personnel and keepers of prisons, penitentiaries, jails and other institutions for the detention of persons accused or convicted of crime, while acting within the scope of their authority;
  6. Members of the armed services or reserve forces of the United States or the Kansas National Guard while in the performance of their official duty.
  7. Armored transport service employees while actually engaged in the performance of the duties of their employment.
  8. Employee of Shawnee County, or the State of Kansas, when necessary for security reasons.
  9. Violation of this resolution is a class B misdemeanor. Prosecution of violations is a class B misdemeanor. Prosecution of violations shall be conducted in the manner provided by law for the prosecution of misdemeanor violations of state laws. The penalty imposed shall be in accordance with the penalties established by law for conviction of a class B misdemeanor.
  10. Signs clearly stating that possession of firearms within the courthouse building is prohibited, shall be posted in conspicuous places within the county courthouse building.
  11. This resolution shall take effect upon publication in the official county newspaper.
