RESOLUTION AMENDING THE FOLLOWING ORDINANCES

6.04.040 Collection of Solid Waste. The City shall provide for the collection of solid waste as follows:

(a) Residential Collection. The City shall provide for the collection of residential solid waste and recyclables for the entire city.

(b) Commercial Collection. The City may, at its discretion, provide for the collection of commercial solid waste upon specific application of the owners, or persons in charge of commercial establishments; provided, however, that in the event that such application is not made or approved, it shall be the duty of such establishment to provide for the collection of all solid waste produced upon any such premises. 6.04.115 Special Residential Recycling Program.

(a) A special curbside recycling program is hereby established for the benefit of residential solid waste collection customers of the City who voluntarily subscribe and pay a curbside recycling charge.

(b) Persons desiring to use the City pickup service shall notify the City of such decision by returning a mailed form to the City.

(c) Persons desiring to take recyclable materials to pickup locations operated by any public or private enterprise may do so, and thus bypass the City curbside recycling program for some or all their recycling needs.

(d) Curbside residential recycling charges shall be established by the Governing Body of the City by resolution.

(e) The City Manager shall have the authority to promulgate rules and regulations on:

(1) Days of collection of residential recyclables;

(2) Pre-collection practices;

(3) The type, color and physical dimensions of recycling bins or containers; and

(4) Specific materials to be collected for recycling.

(f) All recyclable materials shall become the property of the City when it is placed at the curbside for collection or placed in a color-coded container to be saved for collection day. It shall be unlawful for any person not authorized by the City to remove any item placed for recyclable collection from any recycling container.
