Inmate Work Release Fees

RESOLUTION 05-19-03

 

A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF GEARY COUNTY, KANSAS, IMPOSING A FEE FOR INMATES ENGAGED IN WORK RELEASE DURING DETENTION AT THE GEARY COUNTY DETENTION FACILITY

 

WHEREAS, the Sheriff of Geary County is the keeper of the jail pursuant to statute, K.S.A. 19-805; and

 

WHEREAS, the Board of County Commissioners of Geary County, Kansas, provides to the Sheriff a budget to keep and maintain the Geary County Jail; and

 

WHEREAS, inmates housed in the Geary County Jail are detained subject to work release orders imposed by the Courts which have committed said prisons to the Sheriff for incarceration and detention; and

 

WHEREAS, K.S.A. 19-1931(d) provides that the Board of County Commissioners of a county may provide by resolution that any inmate of the County Jail who participates in a work release or job training program for which the inmate receives compensation or subsistence allowance shall be required to pay to the County a per diem fee, set by Resolution 10-12-99 in the amount not exceeding $10.00 per day to defray cost of the maintaining of such inmate in the County Jail; and

 

BE IT NOW HEREBY RESOLVED that the Board of County Commissioners of Geary County, Kansas, does by this action require and resolve that any inmate committed to the custody of the Sheriff for detention at the Geary County Detention Facility who participates in a work release or job training program ordered by any Court committing such inmate, shall be required to pay to the County an amount not to exceed $20.00 per day during the period of such inmate’s incarceration to aid in defraying the costs of maintaining such inmate in the County Jail;

 

            BE IT FURTHER RESOLVED that in cases where the requirement of such payment would create an undue hardship for the inmate, such per diem fee may be reduced or eliminated, in the exercise of the discretion of the Sheriff who is the keeper of the jail.

 

            BE IT FURTHER RESOLVED that the provisions of K.S.A. 19-1931 not set forth verbatim herein are incorporated herein as though more fully set forth, and that the daily work release payment form which is attached hereto and incorporated herein as though more fully set forth, is approved this date. Resolution 10-12-99 is repealed effective 7-01-03, when the provisions of this Resolution shall become effective and be enforced.
