Alcoholic Liquors and Cereal Malt Beverages Hours of Operation

COUNTY RESOLUTION NO. 85-2

A RESOLUTION REGULATING AND ESTABLISHING HOURS FOR OPERATION OF ESTABLISHMENTS LICENSED TO SELL CEREAL MALT BEVERAGES IN OPEN CONTAINERS.

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF CHAUTAUQUA COUNTY, KANSAS:

SECTION 1    That the closing hours of any establishment licensed to sell cereal malt beverages with Chautauqua County, Kansas, shall be as follows:

A. At or before 12:00 midnight of any day allowed by state law for the sale of cereal malt beverages for consumption on the premises, all sales shall cease and the bar shall close.

B. At 12:00 midnight of any day authorized for sale of cereal malt beverages in accordance with the laws of the State of Kansas, any establishment selling cereal malt beverages for consumption on the premises shall close. That is, all patrons must leave the premises at or before 12:30 a.m. and the doors must be locked.

C. No sale of cereal malt beverages shall be permitted any earlier than 9:00 a.m. of any day.

D. That in those establishments licensed as private clubs, sale of alcoholic liquor and/or cereal malt beverages shall continue as allowed by state law. However, this subparagraph shall not be construed as an enlargement of hours of operation beyond those established by county resolution relating to operation of clubs licensed in accordance with the provisions of K.S.A. 41-2601, et seq.

E. That no person under the age of 18 years shall be allowed in or to remain in any establishment licensed for sale on the premises, unless accompanied by their parents. The licensee of any establishment which serves cereal malt beverages on the premises shall insure that this provision is enforced.

SECTION 2.  That this resolution is intended solely and purely for the purpose of controlling the hours of operation of cereal malt beverage licensees, and does not change or have any effect on previous requirements for obtaining a license, and does not, in any way, enlarge rights conferred upon cereal malt beverage licensees by the State of Kansas.

SECTION 3.  That any person, corporation, firm or association violating any provision of this resolution shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $500 or by imprisonment in the county jail for not more than six months, or by both such fine and imprisonment.

SECTION 4.  The regulations contained in this resolution and penalties provided in this resolution shall be in addition to and supplementary to those contained in K.S.A 41-2701 et seq, regulating the sale of cereal malt beverages in the State of Kansas.

SECTION 5.  This resolution shall become effective upon publication in the official county newspaper, The Sedan Times Star.
