RESOLUTION NO. 4

A RESOLUTION PROVIDING THAT THE CORPORATE CITY LIMITS OF THE CITY OF NEOSHO RAPIDS, KANSAS BE MADE A PART OF RURAL FIRE DISTRICT NO. 5 OF LYON COUNTY, KANSAS.

WHEREAS, the City Council of the City of Neosho Rapids, Lyon County, Kansas, on the 13th day of March, 1985 passed a Resolution providing for the City Limits of Neosho Rapids, Lyon County, Kansas to be incorporated into Rural Fire District No. 5 of Lyon County, Kansas.

The governing body of the City of Neosho Rapids, Kansas by a majority vote requests that all of the City of Neosho Rapids, Kansas, be included within the Rural Fire District No. 5 of Lyon County, Kansas. The governing body also requests that this Petition be heard by the Board of County Commissioners at the earliest meeting thereof.

WHEREAS, the City Council by a majority vote authorizes the passage of a City Council by a majority vote authorizes the passage of a City Ordinance for the inclusion of the City of Neosho Rapids, Kansas into Rural Fire District No. 5 of Lyon County, Kansas.

RESOLUTION

WHEREAS, The Board of County Commissioners of Miami County, Kansas, have created a Fire District NO. 1, County of Miami, Kansas and,

WHEREAS, The Board has determined that it is in the best interest of the county to place the supervision of said fire district under a fire district board of trustees,

BE IT RESOLVED, that there is herby created a board of trustees for Fire District No. 1, County of Miami, Kansas, in accordance with K.S.A. 19-3612a.

BE IT FURTHER RESOLVED that the official name of the board of trustees shall be:  FIRE DISTRICT NO. 1, COUNTY OF MIAMI, KANSAS, BOARD OF TRUSTEES.

BE IT FURTHER RESOLVED that the board of trustees will consist of seven members who shall serve at the pleasure of the Board of County Commissioners for Miami County, Kansas.

BE IT FURTHER RESOLVED, that the board of trustees is vested with all of the powers that are vested in the Board of County Commissioners by statute in regards to fire districts and their management.

BE IT FURTHER RESOLVED that the board of trustee’s duties will commence as soon as the board is totally chosen.

 

CONSTITUTION AND BY-LAWS FOR MIAMI COUNTY RURAL FIRE DISTRICT NO. 1

 

ARTICLE I

Section 1.  The name of this organization shall be Miami County Rural Fire District Number 1.

Section 2.   The principle location for regular and business meetings shall be in the Miami County Courthouse, Paola, Kansas.

 

ARTICLE II

(Purpose and Objectives)

Section 1.   The purpose and objectives of the Miami County Rural Fire District No. 1 are as follows;

  1. To prevent and suppress wildfires in all areas of the county.
  2. To cooperate with all firefighting agencies in Miami county and surrounding counties.
  3. To educate the public in fire safety, fire prevention, and fire reporting.
  4. To affect a continuing training program that will assure all firemen are trained and capable of meeting emergencies.
  5. To acquire and equip firefighting equipment for the purpose of fighting, controlling, and putting out fires that are out of control in the District.
  6. To hold such real and personal property as may come into its possession by will, gift, purchase, or otherwise, as authorized by law, and to acquire and dispose of such real and personal property, as may be necessary and convenient for the proper conduct and operation of the business of the District.
  7. To enter into contracts and agreements for the purpose of accomplishing the purpose of the District with any person or governmental agency.
  8. To perform any and all lawful acts necessary or desirable for the accomplishment of the purpose of the District under the laws of the State of Kansas.

 

ARTICLE III

(Membership)

 

Section 1.         Any property owner directly or indirectly interested in public safety, fire protection or prevention may participate in a regular meeting.

Section 2.         There will be seven divisions of the Miami County Rural Fire District No. 1 and will be organized to include the following areas, and henceforth will be known as fire divisions. (Map attached showing boundaries of divisions.)

Section 3.         Each fire Division will have a Fire chief and sufficient number of firemen for its Division.

Section 4.         The Miami County Rural Fire District No. 1 Board of Trustees will be composed of seven members appointed by the County Commissioners.

  1. There shall be a president, vice-president, deputy secretary to be selected by the Board of Trustees at their first meeting on the second Monday in January.
  2. The Board of Trustees will meet monthly and shall have such further meetings as called by the president. A majority of all members shall constitute a quorum.
  3. The trustees and officers shall be paid ten dollars per meeting plus $ 0.13 per mile.
  4. With authority passed to the Fire Board of Trustees from county commissioners by resolution, the Miami Count Board of trustees shall have general control and supervision of the Miami County Rural Fire District No. 1, and shall receive, hold, manage, and control any and all property of the Miami County Fire District No. 1 as trustees of the same.

 

ARTICLE IV

(Officers)

Section 1.         It shall be the duty of the President to preside over all meetings and to call special meetings as the need arises,

Section 2.         It shall be the duty of the Vice-president to assist the President and preside in his absence.

Section 3.         It shall be the duty of the Deputy Secretary to maintain a complete record of all meetings and activities of the Miami County Rural Fire District No. 1 and render a complete report of these records at each meeting to the Board of Trustees.

Section 4.         It shall be the duty of the Deputy Secretary to maintain a complete record of the financial transactions of the Miami County Rural Fire District No. 1 and render a complete report of the financial condition at each meeting to the Board of Trustees and at the annual meeting of the Miami County Rural Fire District No. 1.

  1. It shall be the duty of each City or Division to fulfill the same obligations of Treasure to the Fire Board.

 

ARTICLE V

(Annual Meeting)

 

Section 1.         The Annual Meeting of the Miami County Rural Fire District No. 1 shall be held in December, but must be held at least three weeks in advance of the second Monday in January.

 

ARTICLE VI

(Amendments)

 

Section 1.         This Constitution and By-Laws may be amended at any annual meeting of the Miami County Rural Fire District No. 1. Amendments shall be submitted in writing and may be adopted by a two-thirds majority of those present, providing that the proposed change was discussed at the previous regular meeting.

 

ARTICLE VII

(Basis of Operation)

 

Section 1.         The District shall at all times be operated on a non-profit basis for the mutual benefit of its participating members.

 

ARTICLE VIII

(Copies)

 

Section 1.         After adoption, this Constitution and By-laws shall be prepared in copy form, and a copy thereof shall be delivered to each governmental agency as required by law.

 

COFFEY COUNTY RESOLUTION NO. 543

 

LYON COUNTY RESOLUTION NO. 9-96

(A RESOLUTION INCREASING THE MEMBERSHIP ON LYON COUNTY RURAL FIRE DISTRICT #5 FROM THREE TO FIVE)

 

WHEREAS, the Board of County Commissioners of Lyon County, Kansas met in due and regular session this 22nd day of February, 1996; and

WHEREAS, the Board of County Commissioners of Coffey County, Kansas met in due and regular session this 26th day of February, 1996; and

WHEREAS, the Board of County Commissioners of Lyon County, Kansas established Lyon County Rural Fire District #5 on April 22, 1982 covering certain portions of Lyon County; and

WHEREAS, Lyon County Rural Fire District #5 has entered into contracts with Coffey County for the fire protection of certain portions of Coffey County; and

WHEREAS, the original board of Lyon County Rural Fire District #5 was created with three (3) members; and

WHEREAS, it has been found to be in the better public interest that said board be increased from three (3) members to five (5) members with one of the members appointed by the Board of County Commissioners of Coffey County and four (4) of the board members appointed by the Board of County Commissioners of Lyon County.

NOW, THEREFORE, BE IT RESOLVED, ORDERED, AND ORDAINED by the Board of County Commissions of Lyon and Coffey County that the numbers of the board of directors of Lyon County Rural Fire District #5 shall be increased from three (3) members to five (5) members with one (1) member appointed by the Board of County Commissioners of Coffey County and four (4) members appointed by the Board of County Commissioners of Lyon County.

This resolution shall be effective upon passage by both Boards of County Commissioners.

ESTABLISHMENT OF FIRE DISTRICT NUMBER FIVE,

LYON COUNTY, KANSAS

 

WHEREAS, the Board of County Commissioners of Lyon County, Kansas, has power under and by virtue of K.S.A. 19-3601, et seq., as amended, to organize and cause to be organized one or more fire districts in Lyon County, State of Kansas, and

 

WHEREAS, the Board has made due and regular inquiry in and among many and various constituents concerning their desire and the advisability of establishing and organizing fire districts for the protection of lives and property from the hazards of fire in and about the said county, and

 

WHEREAS, this Board believes that it will greatly further the public welfare and that is advisable and in the public interest that one or more additional fire districts be organized in and within Lyon County, Kansas, for the protection  of lives and property from the hazards of fire, and

 

WHEREAS, the Board published and caused to be published notice that a hearing on the advisability of the organization of said district be held in the Commissioner’s chambers in the County Courthouse at Emporia, Kansas on March 11, 1982, at 10:30 a.m., and included in said notice so published was full and complete map indicating the proposed fire district to encompass the following described real estate in Lyon County, State of Kansas, and

 

WHEREAS, this Board finds that it is advisable to establish and organize this fire district for the protection of lives and property form the hazards of fire and that it is in the public interest and necessary that said fire district be organized.

 

NOW, THEREFORE, BE IT RESOLVE by the Board of County Commissioners of Lyon County, Kansas, that Fire District Number Five (5), County of Lyon, Kansas, be and is now and hereby established and organized

That the Fire District so established by this resolution of the Board shall encompass, contain and consist of all the following real estate in Lyon County, Kansas,

That this Board of County Commissioners hereby rescinds all and any other prior resolutions forming or attempting to form any Fire District designated as Fire District Number 5, Lyon County, Kansas.

That this Board of County Commissioners, pursuant to law, further directs that a copy of this Resolution be published in the official county newspaper of the County one time; that this Resolution when published, shall serve as notice of the establishment of said fire district.

This Resolution is ordered entered at length upon the records of this Board and is adopted at a regular meeting this 22nd day of April, 1982.

 RURAL FIREFIGHTING SERVICE CONTRACT

 

THIS CONTRACT made and entered into this _____ day of __________, 1996, by and between the City of Paola, hereinafter referred to as “City”, and Miami County Rural Fire District No. 1, a fire district organized and existing under the provisions of K.S.A. 19-3601, et seq., hereinafter referred to as “District”.

 

WHEREAS, the City is engaged in providing first response fire protection and related services of emergency first response and rescue services, hereinafter referred to collectively as “Fire Protection Services”, within the city limits of Paola, Kansas, and for those purposes has acquired fire station buildings, fire trucks, including pumpers and tankers, together with the necessary equipment therefore, and the City has available the services of a number of trained firefighters, which Fire Protection Services are provided from the City’s fir station located at _____East Peoria, Paola, Kansas; and

 

WHEREAS, the District is authorized by K.S.A.  19-3601(a) and K.S.A. 19-3612(a) to enter into contracts to effectuate the purposes for which it was organized and is desirous of obtaining by contract the Fire Protection Services form the City for the area contained in the District, the boundaries of which are indicated on the map of the District marked Exhibit “A”, attached hereto and by this reference thereto make a part hereof the same as if fully set forth herein, and the City is agreeable to providing such Fire Protection Services upon the terms, conditions, provisions and for the consideration set forth herein below.

 

NOW, THEREFORE, in consideration of the foregoing recitals and the mutual covenants and promises hereinafter set forth, the parties hereto have agreed and do hereby agree as follows:

 

  1. AREA TO BE SERVED. The city hereby agrees to provide Fire Protection Services to the inhabitants and property located within the geographic territory of the District as described in Exhibit “A”, attached hereto.
  2. CITY’S EQUIPMENT, FACILITIES AND SERVICES.
  3. Equipment: The City shall furnish the following vehicles and equipment and the City shall maintain said equipment and pay for the repairs thereof:
  4. Facilities: The City shall furnish the following facilities to house the aforesaid firefighting trucks, equipment and necessary appurtenances thereto:

  1. Personnel: The City shall furnish the personnel necessary to operate the fire trucks, firefighting equipment and appurtenances thereto needed to provide the Fire Protection Services to the District.
  2. Records and Reports: The City shall maintain such records and reports in respect the subject matter hereof as are customarily kept by the City Fire Department and similar fire protection providers within the State of Kansas. The City shall report bi-annually the types of fires and other incidents responded to by number, estimated losses, suspected fire causes, estimated value property involved, and number of personnel responding to emergencies and such other reasonable data as the District may request.
  3. Responsibility for Safety of Equipment: The City shall maintain its equipment and operation thereof in a safe manner at all times.
  4. Alarm Response: The City shall dispatch at least one (1) piece of fire equipment upon any alarm regardless of its nature, where there is a fire or imminent danger of fire, unless the City has actual knowledge that the alarm is false, and shall provide such further equipment and personnel as is deemed necessary and appropriate to the situation. The City shall take such other steps as may be responsible and prudent to fight said fire, including, but not limited to, requesting aid from other fire departments and firefighting facilities, including, but not limited to, other fire departments with which it may presently contract for Fire Protection Services. The City shall be permitted to aid other fire departments with reasonable manpower, equipment and apparatus at times such other fire departments may request assistance upon a recognized and established mutual aid basis.
  5. Emergency First Response and Rescue Services: The City shall provide emergency first response and rescue services to the area to be served. It is understood by the parties hereto that emergency medical assistance per se is not included among these services: however, certain of the personnel responding to a given emergency call my posses EMT or CPR training, which they may utilize as appropriate to the particular situation.
  6. Training: The City agrees to see that all firefighting personnel performing Fire Protection Services pursuant to this Contract are trained in an appropriate manner consistent with the structure of such fire department in which they may serve. Provides accept complete responsibility for said training.

 

  1. DISTRICT’S EQUIPMENT.  The District agrees to furnish the following firefighting equipment, and the District shall maintain said equipment and pay for the repairs thereof:
  2. SEPARATE EQUIPMENT. It is specifically understood and agreed by the parties hereto that the City’s firefighting trucks, equipment and all appurtenances thereto are the separate and distinct property of the City and that the District’s firefighting trucks, equipment and appurtenances thereto are the separate and distinct property shall be maintained for the owner’s use by (only) the owner thereof.
  3. TERM.  The initial term of the Contract shall be for a period of twelve (12) months commencing on the 1st day of _________, 1996 and ending on the 31st day of ____________, 1997, unless said term shall be sooner terminated for default as hereinafter provided. This Contract shall be automatically renewed from year to year hereafter unless and until either party gives notice in writing to the party at least sixty (60) days prior to the 31st day of __________ of its intention to terminate this Contract for the next contract year.
  4. CONSIDERATION.  The District agrees to pay the City compensation for providing the equipment, facilities and services set forth herein based upon the use of the City’s equipment, the cost of material used and firemen’s pay incurred when providing Fire Protection Services to the District as follows:
  5. USUAL AND CUSTOMARY SERVICES. It is understood and agreed by the parties hereto that the City shall provide only such Fire Protection Services as are deemed usual and customary in view of the Contract herein and the consideration to be paid the City pursuant hereto.
  6. NODISCRIMINATION. The City shall comply with all applicable state and federal laws, regulations and executive orders relating to employment discrimination on the basis of race, religion, color, sex, national origin, physical handicap, alienage and age.
  7. BREACH OR DEFAULT. In the event any party hereto shall commence any legal arbitration or other proceeding against the other for breach of this Contract, all expenses, including attorney fees, court or arbitration costs, shall be borne by the party which does not prevail. The City shall have the right on thirty (30) days written notice to cease the Fire Protection Services provided for by this Contract in the event the District fails to pay the consideration provided for in Paragraph _____ within fifteen (15) days of the date due.
  8. SUPERVISION AND CONTROL. Pursuant to K.S.A. 19-3608, the supervision and control of the City’s Fire Department furnishing Fire Protection Services to the District pursuant to this Contract shall be with the Governing Body of the City.  The Fire Chief or person in charge of the City’s Fire Department shall have the right, in every case, to determine whether or not the City can spare all or any portion of its fire equipment and firefighters at any particular time to provide its Fire Protection Services to the District.
  9. LIABILITY. The City shall not be liable in any manner for any acts or failure to act by City employees while furnishing Fire Protection Services outside the City limits of the City to the District, and the District shall hold the City harmless in connection with the City, its employees and agents providing Fire Protection Services to the District, and the District shall indemnify the City for any loss or expenses incurred, including attorney fees, as a result of the City’s employees or agents providing Fire Protection Services outside the city limits of Paola, Kansas to the District,

The District shall provide the City evidence of such insurance coverage annually or whenever requested to do so by the City as well as any and all renewals thereof.

 

The insurance carrier providing the above coverage must show that it:

 

  1. Is licensed to do business in the State of Kansas;
  2. Carries a Best’s policyholder rating of A or better; and
  3. Carries at least a Class X financial rating, or is a company or companies mutually agreed upon by the parties.

 

  1. MISCELLANEOUS

 

  1. Waiver. It is agreed and understood that any failure to strictly enforce any provision hereof shall not constitute a waiver of right to demand strict performance of that or any other provisions hereof at any time hereafter.
  2. Severable Terms. The terms and conditions of this Contract are separate and severable, and if for any reason any court of law or administrative agency should deem any provisions hereof invalid or inoperative, the remaining provisions of this Contract shall remain valid and in full force and effect.
  3. Modification. It is understood that the terms of this Contract may be changed from time to time by mutual agreement of the parties expressed in the form of a Letter of Agreement signed by the authorized officials of the respective parties hereto.
  4. Notices. Any notices required to be given pursuant to the provisions of this Contract shall be given in writing by registered or certified mail, enclosing such notice in a postage prepared enveloped addressed as follows:

  1. Previous Agreements. This Contract embodies the entire agreement between the parties hereto with relation to the subject matter hereof and supersedes any previous agreement or understanding, whether verbal or otherwise, with relation hereto.
  2. Legal Construction. Time is of the essence of this Contract, and this Contract is deemed personal to the parties herein and shall not be transferable or assignable without the mutual consent of all parties and shall be interpreted pursuant to the laws of the State of Kansas.

RESOLUTION

WHEREAS, we the Board of County Commissioners, of Miami County, Kansas, feel that it is advisable in the public interest that Districts be organized in the County for the protection of lives and property form the hazards of fire; and

WHEREAS, we the Board of County Commissioners of Miami County, Kansas, held a public hearing on May 28, 1974, as to the advisability of creating for districts within the County, after publishing legal notice accompanied by a map of the proposed districts, three consecutive weeks in the official county newspaper; and

WHEREAS, The Board of County Commissioners of Miami County Kansas, having heard the different views expressed by the public at the hearing on May 28, 1974, adjourned the meeting to take the matter under advisement and consideration; and

WHEREAS, The Board of County Commissioners of Miami County, Kansas, have weighed and considered this matter for ten months,

BE IT RESOLVED, that Miami County, Kansas be created into a single Fire District in accordance with K.S.A. 19-3601 et seq.

BE IT FURTHER RESOLVED, that the name of the fire district shall be, FIRE DISTRICT NO. 1, County of Miami, Kansas, and described as follows:

All lands lying with the boundaries of Miami County, Kansas, excepting all first, second and third class cities found with said boundaries.

BE IT FURTHER RESOLVED that the effective date of this Resolution will be January 1, 1976.
